Are you considering contesting a will?

If so, all YourDispute.co.uk solicitors are able to act on a No Win No Fee basis. No Win No Fee means that if your case is not successful, you will generally not be responsible for your solicitor's costs. Meanwhile, if your claim is successful, you will usually be able to recover legal costs from your opponent.

Challenging a will, is a fairly common occurrence, for example where adequate support has not been made for loved ones and dependants in the original will, or if there is some dispute over the validity of the will itself. This could include the deceased having been pressurized when they made their will.

If you are struggling following the death of someone close to you, it is important to get specialist legal advice straight away to find out if you have a case. Procedures can be put in place to prevent the deceased's assets being distributed for six months or more. We can put you in touch with a specialist solicitor to discuss your case.

Our professional service

At YourDispute.co.uk, we understand how painful and disorientating it can be when someone we know passes away, especially if that person was a close family member or loved one.

We also understand that a person's will can leave you feeling upset, shocked, and even angry, if the will they have left is not what you expected. For example, money you need to live on has been passed to someone else.

It is vital to gain legal advice straight away if you are thinking of contesting a will, even though bereavement and its aftermath can be a difficult time.

We will handle your enquiry with the necessary discretion and consideration, and do not charge you for this service.

We can transfer you to experienced solicitors who will give you the best available advice in dealing with your claim. What's more, many claims are handled on a no win no fee basis, which our solicitors can discuss with you in more detail.

Can I claim under the Inheritance Act?

To find out whether you are entitled to make a claim under the Inheritance Act, it is important to gain professional advice as soon as possible. If you feel you have not been provided for in a will when you should have been, you may have a valid claim. You will need to show that you are:

  1. A husband, wife, civil partner or cohabitee of the deceased
  2. A former husband, wife or civil partner of the deceased who was receiving maintenance and has not remarried/entered into a new civil partnership
  3. A child of the deceased
  4. Any person who was treated as a 'child of the family' of the deceased
  5. Any person who was partly or wholly maintained by the deceased immediately before the death

Please act quickly and contact us. We can put you in touch with a specialist solicitor to discuss your potential case.

Grounds for contesting a will:

A person can make a will leaving money and other assets to anyone, but sometimes there are circumstances where a will can be successfully challenged. For example:

  1. The will does not reflect the wishes of the deceased because it was drafted negligently or contrary to the instructions of the deceased.
  2. The will was signed under undue influence, for example the deceased was pressured into signing the will.
  3. The deceased lacked the necessary mental capacity to sign or to give instructions for a will, e.g. the person was suffering from dementia or a similar mental illness when the will was made
  4. The will has been drafted and signed incorrectly, which is often a problem with homemade wills

Even if a will is valid, you may be able to claim against the solicitor or other professional if they negligently drafted the will

We deal with probate claims where the deceased was resident in England or Wales and where the estate has a value of more than £100,000.

Bereavement support

When we lose someone close to us, we can be overcome by emotion. While the concept of grief is common to most of us, it is difficult to know what it entails, or how coping with bereavement will affect us personally, until we ourselves suffer the loss of someone.

While many people find there is no need for professional bereavement support, as support from friends and family members may be enough to provide for their emotional needs, in other cases people may need outside help in coping with bereavement.

In the UK there are organisations which offer bereavement support to those coping with bereavement. Cruse Bereavement Care, for example, offers free bereavement support from trained individuals in England, Wales and Northern Ireland.
